Privacy notice
This notice explains how IX Recovery uses personal information when we research potential claims, contact people who may be entitled to funds, help progress a recovery, or receive an enquiry.
1. Who we are
IX Recovery identifies potentially unclaimed funds, researches who may be entitled to them, and helps claimants navigate the evidence and recovery process.
For the purposes of UK data protection law, IX Recovery is the controller of the personal information described in this notice. You can contact us about privacy or data protection at hello@ixrecovery.com.
2. Information we may use
Depending on the potential claim and whether you choose to work with us, we may use:
- identity and contact information, such as names, previous names, addresses, email addresses and telephone numbers;
- information showing a historic, family, company, estate or other connection relevant to a potential entitlement;
- claim or fund information contained in public records or supplied by the organisation administering the relevant funds;
- identity and evidence documents you choose to provide to support a claim;
- correspondence, instructions and records of our contact with you;
- transaction and payment information where needed to administer an agreed service; and
- limited technical information generated when you use our website or email us, where this is made available to us by our service providers.
3. Where we get information from
We may receive information directly from you. We may also obtain it from other lawful sources before we contact you, including government, court, corporate and other public registers; publicly available records; organisations administering relevant funds or claims; and tracing or identity-verification sources where their use is lawful and appropriate.
If we first obtained your information from somewhere other than you, we will make this privacy notice available when we contact you and explain the basis on which we believe the potential claim may relate to you.
4. Why we use personal information
Researching potential claims
We typically rely on our legitimate interests in identifying credible potential claims and offering a recovery service, balanced against the individual’s rights and reasonable expectations.
Contacting a potential claimant
We may rely on legitimate interests where appropriate. Separate communications rules may also apply depending on how we contact you.
Responding to enquiries and assessing a recovery
We may process information to take steps you ask us to take before entering into a contract and/or on the basis of legitimate interests.
Providing an agreed service
Where you engage us, we process relevant information to perform our contract with you.
Legal, security and administrative requirements
We may process information to meet legal obligations and for legitimate interests in preventing fraud, protecting our systems and records, administering our business and handling disputes.
Where we rely on legitimate interests, we consider the purpose, necessity and likely impact on the individual. You can object to processing based on legitimate interests; see “Your rights” below.
5. Who we may share information with
We do not sell personal information. Where necessary, we may share relevant information with:
- the organisation, court, authority, fund administrator or other body responsible for the relevant claim;
- service providers supporting hosting, email, secure document handling, identity checks, tracing, professional services or payment administration;
- our legal, accounting or other professional advisers; and
- law-enforcement, regulators, courts or public authorities where disclosure is required or permitted by law.
We only share what is reasonably necessary for the relevant purpose and expect service providers acting for us to protect personal information appropriately.
6. International transfers
Some technology or service providers may process information outside the UK. Where UK data protection law requires safeguards for an international transfer, we will use an appropriate lawful mechanism or rely on another permitted basis for the transfer.
7. How long we keep information
We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected and for any legal, accounting, evidential or dispute-resolution requirements that apply afterwards.
Research relating to a potential claimant is reviewed and should be deleted or minimised when there is no longer a reasonable prospect of a relevant claim or another lawful reason to retain it. Where you enter into an agreement with us, some records may need to be retained for longer to administer the service, meet legal obligations and deal with later queries or disputes.
8. Your rights
Depending on the circumstances, UK data protection law may give you rights to:
- ask for a copy of the personal information we hold about you;
- ask us to correct inaccurate or incomplete information;
- ask us to erase information or restrict how we use it;
- object to processing based on legitimate interests;
- receive certain information in a portable format; and
- withdraw consent where consent is the basis on which we are using information.
These rights are not absolute and exemptions can apply. To exercise a right, contact hello@ixrecovery.com. We may need to confirm your identity before acting on a request.
9. Automated decision-making
We do not make decisions about whether you are entitled to funds solely by automated means. Research and matching tools may help us identify potential connections, but a potential match is reviewed before we ask you to take action.
10. Cookies and website data
Our current public website does not use analytics, advertising or marketing cookies. See our cookie notice for the current position.
11. Complaints
Please contact us first if you have a concern about how we have used your information. You also have the right to complain to the UK Information Commissioner’s Office (ICO). More information is available at ico.org.uk/make-a-complaint.
12. Changes to this notice
We may update this notice as the service develops or if our use of personal information changes. The latest version will always be published on this page with its update date.
